Privacy Policy.

This Privacy Policy explains how AU MEDIA GROUP LLC collects, uses, discloses, and protects information in connection with Auvion (the "Service"), and describes the rights and choices available to you. By accessing or using the Service, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with it, please do not use the Service.

This Privacy Policy is incorporated into and subject to our Terms and Conditions.

1. Interpretation

Capitalized terms have the meanings defined below. Words in the singular include the plural and vice versa.

2. Definitions

Account
A unique account created for you to access the Service.
Application
Auvion, the software platform provided by the Company.
Business Customer
An organization that subscribes to or uses the Service, including its authorized users.
Company
"we," "us," or "our" — AU MEDIA GROUP LLC, 7901 4th St N, Ste 300, St. Petersburg, FL 33702, United States.
Cookies
Small files placed on your Device that store browsing and usage information.
Device
Any device that can access the Service, such as a computer, phone, or tablet.
Personal Data
Any information that relates to an identified or identifiable individual.
Service
The Website, the Application, the SaaS platform, and all related services provided by Auvion.
Service Provider
Any third party that processes data on our behalf to help provide the Service.
Usage Data
Data collected automatically from your use of the Service.

The individual or legal entity accessing or using the Service.

3. The information we collect

3.1 Information you provide to us

  • Identity and contact data — first and last name, email address, phone number.
  • Business data — company name, business address, role or title, and other business information you provide.
  • Account credentials — username, password, and authentication data.
  • Billing data — billing name, billing address, and subscription details. Payment card numbers are collected and processed directly by our third-party payment processor; we do not store full card numbers on our systems.
  • Communications — information you submit through support requests, forms, or correspondence with us.
  • Customer Content — data, records, and content you or your authorized users upload to or generate within the Service.

3.2 Information collected automatically (Usage Data)

  • IP address and approximate location derived from it
  • Browser type and version
  • Device type and operating system
  • Mobile device identifiers
  • Pages visited, features used, and time spent
  • Date and time of visits and referring URLs
  • Diagnostic, performance, and analytics data

3.3 Cookies and tracking technologies

We use cookies and similar technologies (such as web beacons, pixels, and analytics scripts) to operate, secure, and analyze the Service. These include:

  • Strictly necessary cookies — required for the Service to function (e.g., login sessions, security).
  • Functional cookies — remember your preferences and settings.
  • Analytics cookies — help us understand how the Service is used so we can improve it.

You can manage or disable cookies through your browser settings, but some features may not function properly without them. Where required by law, we request consent before placing non-essential cookies. We do not currently respond to browser "Do Not Track" signals; however, we honor recognized opt-out preference signals (such as Global Privacy Control) where legally required.


4. How we use your information

We use Personal Data for the following purposes:

  • To provide, operate, and maintain the Service
  • To create and manage Accounts and authenticate users
  • To process subscriptions, billing, and payments
  • To respond to inquiries and provide customer support
  • To send service-related notices, security alerts, and administrative messages
  • To improve, personalize, and develop the Service and new features
  • To monitor usage, detect and prevent fraud, abuse, and security incidents
  • To send marketing and promotional communications, where permitted (you may opt out at any time)
  • To comply with legal obligations and enforce our agreements

We rely on one or more of the following bases for processing, as applicable: performance of a contract with you; your consent; our legitimate business interests (such as securing and improving the Service); and compliance with legal obligations.


5. How we share information

The Service is delivered using a third-party technology platform. As a result, your information may be shared as described below. Please review the "Sale or Sharing of Personal Information" section below for your opt-out rights.

  • With Service Providers and our platform provider — vendors and the technology platform that operate the Service on our behalf, including cloud hosting and infrastructure, payment processing, analytics, email delivery, and customer support tooling. These parties may process Personal Data to provide, maintain, monitor, and analyze the Service.
  • With affiliates — entities that control, are controlled by, or are under common control with the Company or our platform provider. We require affiliates to honor this Privacy Policy.
  • With business partners — we (and our platform provider) may share Personal Data with business partners to offer you products, services, or promotions.
  • With other users — if the Service includes public or shared areas, information you post there may be viewed by, and distributed to, other users and the public.
  • With your direction — where you or your organization instruct us to share or integrate data (for example, with a third-party integration you enable).
  • Business transfers — in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets, in which case Personal Data may be transferred as part of the transaction. We will provide notice before your Personal Data becomes subject to a different privacy policy.
  • Legal and safety — when required by law, subpoena, or legal process, or to protect the rights, property, or safety of the Company, our users, or others.
  • With your consent — for any other purpose disclosed to you at the time we collect the information.

Within a Business Customer's organization, account administrators may have access to the Personal Data and Customer Content associated with their organization's Account.


6. Healthcare data and HIPAA

Auvion may be used by healthcare-adjacent businesses, including medical spas, aesthetic clinics, and wellness providers.

The Service is not intended to receive, store, or process Protected Health Information ("PHI") as defined under the Health Insurance Portability and Accountability Act ("HIPAA"), and the Company does not act as a "Business Associate" unless it has signed a separate written Business Associate Agreement ("BAA") with you. In the absence of an executed BAA, you agree not to submit PHI to the Service.

You are solely responsible for ensuring your own compliance with HIPAA and any other healthcare-privacy or data-protection laws applicable to your business and your use of the Service. We will take commercially reasonable measures designed to protect the data processed through the Service, but this does not make the Company a Business Associate absent a BAA.


7. Data retention

We retain Personal Data only for as long as necessary to fulfill the purposes described in this Policy, including to provide the Service, comply with our legal obligations, resolve disputes, and enforce our agreements. When data is no longer needed, we delete it or de-identify it. Retention periods vary depending on the type of data and the purpose for which it was collected. Customer Content is retained according to your subscription and is generally deleted or returned following account closure, subject to our backup cycles and legal-retention requirements.


8. Data security

We maintain commercially reasonable administrative, technical, and physical safeguards designed to protect Personal Data against unauthorized access, loss, misuse, or alteration. These may include encryption in transit, access controls, and monitoring. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we become aware of a security incident affecting your Personal Data, we will notify affected parties as required by applicable law.


9. Your U.S. state privacy rights

Depending on your state of residence, you may have some or all of the following rights regarding your Personal Data:

  • Right to know / access — request the categories and specific pieces of Personal Data we have collected about you.
  • Right to correct — request correction of inaccurate Personal Data.
  • Right to delete — request deletion of your Personal Data, subject to legal exceptions.
  • Right to opt out — opt out of the "sale" or "sharing" of Personal Data and of targeted advertising. See "Sale or Sharing of Personal Information" below for how to exercise this right.
  • Right to limit — limit the use of sensitive Personal Data where applicable.
  • Right to non-discrimination — we will not discriminate against you for exercising these rights.

How to exercise your rights

To make a request, contact us at artin@auvion.app. We may need to verify your identity before fulfilling your request. You may use an authorized agent to submit a request on your behalf where permitted by law; we may require proof of authorization. We will respond within the timeframe required by applicable law (generally 45 days, with the possibility of extension).

Sale or sharing of personal information

The Service operates on a third-party technology platform, and Personal Data may be shared with the platform provider, its affiliates, and business partners as described in Section 5 — including to offer products, services, or promotions. Some of these disclosures may be considered a "sale" or a "share" of Personal Data under California and other state privacy laws.

You have the right to opt out of the sale or sharing of your Personal Data. To opt out, contact us at artin@auvion.app with the subject line "Do Not Sell or Share My Personal Information," and we will process your request and direct our platform provider to do the same. We will not discriminate against you for exercising this right.

Categories of information (for California and similar states)

In the preceding 12 months, we may have collected the following categories of Personal Data: identifiers (such as name, email, IP address); commercial information (such as subscription and transaction records); internet or network activity (such as Usage Data); professional or employment-related information (such as business role); and financial information necessary for billing. We collect this information from you, from your use of the Service, and from our Service Providers and platform provider. We use and disclose it for the business and commercial purposes described in Sections 4 and 5, which may include disclosure to affiliates and business partners.


10. Children's privacy

The Service is intended for businesses and is not directed to individuals under 18 years of age. We do not knowingly collect Personal Data from anyone under 18. If we learn that we have collected such data, we will delete it. If you believe a minor has provided us with Personal Data, please contact us at artin@auvion.app.


11. International users and data transfers

The Service is delivered using a third-party technology platform whose operators and affiliates may be located outside the United States, including in the United Kingdom and other jurisdictions. As a result, your information may be transferred to, stored, and processed in countries other than your own, where data-protection laws may differ from those in your jurisdiction. We (and our platform provider) take steps reasonably necessary to ensure your data is treated securely and in accordance with this Privacy Policy. By using the Service, you consent to this transfer and processing.


12. Third-party links and services

The Service may contain links to, or integrations with, third-party websites and services that we do not control. This Privacy Policy does not apply to those third parties, and we are not responsible for their content or privacy practices. We encourage you to review the privacy policies of any third-party services you use.


13. Changes to this policy

We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Changes become effective when posted on this page. Your continued use of the Service after changes take effect constitutes acceptance of the revised Policy.
